The Officer Wrote the Wrong Driver’s License Number, Zip Code and Speed Limit on my Ticket. What Should I do?
If you receive a ticket or Virginia Uniform Summons, you need to double check all the information on the summons. Errors on the ticket could be a defense that we could use in court for your case.
This is a good reason for you to give me a call to discuss the specifics of your case. Not every error on a ticket is going to help in court, but some could.
In this hypothetical example, let’s say the officer put down the wrong maximum speed limit and he got some of your identifying information incorrect on the ticket. Since both of these are fairly important details, we can hopefully argue to the judge that the officer hasn’t proven his case appropriately. It also depends upon how you present these arguments. Just because there is a possible defense doesn’t mean that anyone can just go in and point out the problem and get the case dismissed.
Some of these ticket errors can be corrected by the officer before the case is heard. I have seen where people without an attorney go in and say “But judge there is a mistake on the ticket” and the judge asked the officer for the correct information and the judge corrects the ticket. That’s usually the wrong approach to leveraging a mistake like this.
To discuss any possible errors on your ticket, give me a call today so we can see if there’s something we can do to defend your case.
